1. Purpose and Scope

This Distance Sales Agreement (“Agreement”) is entered into under Turkish Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation. It governs the rights and obligations of the parties regarding the distance sale of digital intermediary services, job / task listing management, use of the payment infrastructure, collection of platform service fees, and related electronic services provided through the SearchandWork platform.

SearchandWork is not a conventional e-commerce store and does not sell physical goods. The platform digitally connects employers with students, records task workflows and payments, and provides intermediary services. This Agreement applies together with the Payment and Cancellation Policy, Platform Terms of Use, Employer User Service Agreement, and other relevant platform documents. In case of conflict on payment, refund, and cancellation matters, the Payment and Cancellation Policy prevails.

2. Parties

(Hereinafter “SearchandWork” or the “Seller”.)

2.2. Buyer / Consumer

The natural or legal person user who registers on SearchandWork as an employer or authorized representative and approves this Agreement electronically by entering payment details or initiating a card payment / pre-authorization transaction.

The Buyer’s identity, contact, and billing information consists of the current data on the platform account and the information entered at the time of payment.

3. Subject of the Agreement

The subject of this Agreement is the following digital and intermediary services purchased / ordered by the Buyer through SearchandWork:

  • Creating, publishing, and managing job / task listings,
  • Platform intermediary and matching services,
  • Secure payment infrastructure, card collection, pre-authorization / card hold, and payment recording services,
  • Platform service fees, commissions, or listing / usage charges,
  • Subscription, package, or additional digital service fees (if any),
  • Other platform services separately displayed on the payment screen.

SearchandWork is not a party to student employment or employer–worker relationships. Employment relationships with assigned students are governed by processes outside the platform involving the relevant service provider / employer.

4. Nature, Term, and Performance of the Service

4.1. Services are provided electronically; no physical delivery is made.

4.2. Upon completion of payment approval or pre-authorization, the relevant digital service (listing publication, payment record, platform access, etc.) begins performance with the Buyer’s express consent.

4.3. The term of task / listing-based services is limited to the date and time range shown in listing details, the offer screen, or the payment summary.

4.4. SearchandWork makes reasonable efforts to provide uninterrupted service; it cannot be held liable for indirect damages arising from maintenance, security, or temporary interruptions caused by third-party payment institutions.

5. Price, Taxes, and Payment

5.1. The service fee is displayed to the Buyer clearly and understandably on the payment screen, listing summary, or before invoicing. Whether the amount includes VAT is stated on screen.

5.2. Payment may be made by credit card, debit card, pre-authorization / card hold, corporate account, or other secure methods supported by the platform. Collection is processed through authorized payment institutions and virtual POS infrastructure.

5.3. The Buyer is responsible for the accuracy of payment information and that the card belongs to them.

5.4. The distribution of task fees, student entitlements, and employer payments is carried out according to the model explained in the platform interface and the Payment and Cancellation Policy.

6. Right of Withdrawal

6.1. Before performance of the service begins, the Buyer has the right to withdraw within 14 (fourteen) days without giving any reason and without paying a penalty.

6.2. Under the relevant articles of the Distance Contracts Regulation, the right of withdrawal may not apply or may be limited in the following cases:

  • Services performed instantly in electronic form and digital content / services commenced with the Buyer’s consent,
  • Services relating to events, organizations, or tasks to be performed on a specific date or period,
  • Operations commenced immediately with the Buyer’s express consent, such as listing publication, pre-authorization, or initiation of the task process upon payment approval.

6.3. Withdrawal requests must be submitted in writing to contact@searchandwork.com or through support channels indicated on the platform. Refund conditions and processes are detailed in the Payment and Cancellation Policy.

7. Cancellation, Refund, and Disputes

Task cancellation, late cancellation, student no-show, partial performance, pre-authorization refund, partial refund, and dispute processes are subject to the Payment and Cancellation Policy. SearchandWork acts as an intermediary between the parties and is not responsible for delays arising from payment institution and bank processes.

8. Personal Data

Personal data processed during payment and contract processes is handled under the KVKK Disclosure Notice and Privacy Policy.

9. Complaints and Applications

The Buyer may submit complaints and requests via contact@searchandwork.com. For applications made in a consumer capacity, Consumer Arbitration Committees and Consumer Courts have jurisdiction within legal monetary limits.

10. Electronic Acceptance and Effectiveness

Before entering payment details or completing the payment transaction, the Buyer declares that they have read, understood, and accepted this Agreement electronically. Acceptance is evidenced by platform records, timestamps, and payment transaction logs.

This Agreement enters into force when approved electronically by the Buyer.
